Kimball Properties will provide subcontractors with an Invitation to Bid (ITB) for specific project scopes. The ITB will include detailed project specifications, plans, schedules, and other necessary documents. Subcontractors are responsible for thoroughly reviewing the ITB and clarifying any ambiguities before bid submission.
Submission Requirements
Subcontractors must submit bids in accordance with the following requirements:
Deadline: Bids must be submitted by the specified due date and time. Late submissions will not be accepted.
Format: Bids must be submitted in the format outlined in the ITB and include all required documentation.
Compliance: Bids must fully comply with the scope of work, material requirements, and other specifications provided in the ITB.
Bid Evaluation
Kimball Properties will evaluate bids based on the following criteria:
Completeness: The bid must include all required items and adhere to the ITB specifications.
Competitiveness: Pricing must be reasonable, consistent with industry standards, and aligned with the project budget.
Qualifications: The Subcontractor must demonstrate adequate experience, financial stability, and the capability to complete the work on time and within budget.
Past Performance: The subcontractor’s quality, safety, and compliance history with similar projects will be considered.
Right to Reject Bids
Kimball Properties reserves the right, at its sole discretion, to:
Reject any bid deemed non-responsive, including but not limited to:
Failure to meet submission requirements.
Omissions of required scope items.
Reject any bid deemed non-responsible, including but not limited to:
Unreasonably low or high pricing that raises concerns about the ability to perform the work.
Fails to demonstrate adequate qualifications or capacity to perform the required work.
Fails to demonstrate financial stability.
Fails to demonstrate proper licensing.
Fails to demonstrate proper insurance.
Waive informalities or irregularities in bids if deemed to be in the best interest of the project.
Award of Subcontractors
Kimball Properties is under no obligation to award the contract to the lowest bidder.
Award decisions will be made in the sole discretion of Kimball Properties based on the evaluation criteria specified in Section 9.3.
Kimball Properties may negotiate scope and pricing with any Subcontractor prior to award.
Confidentiality
All bid submissions and related documentation will be treated as confidential and used solely for evaluation purposes. Kimball Properties will not disclose bid details to other Subcontractors or third parties without prior consent except as required by law.
Post-Award Obligations
The Subcontractor selected for the project shall execute a formal Purchase Order (PO) with Kimball Properties, which will include all terms and conditions outlined in the ITB and bid submission. Failure to execute the PO within the specified time may result in forfeiture of the award.
